Terms of Service
These Terms of Service ("Terms") are an agreement between you and Gravitt Digital LLC ("Gravitt Digital," "we," "us"). They apply when you order a website, use our hosting and care services, or otherwise work with us. By checking the agreement box on our order form or paying for our services, you agree to these Terms. You must be at least 18 years old to order or use our services. If you are ordering for a business, you confirm you have the authority to agree on its behalf.
1. Our services
We design, build and host websites for small businesses. Depending on the package you choose, our services include:
- Starter: a one-page website.
- Pro: a multi-page website with a service catalog, and one small update per month while your hosting plan is active.
- Hosting and care: keeping your site online, a security certificate (HTTPS), and connecting your domain.
- Optional extras we may offer, such as domain registration and email forwarding.
The exact package, price and inclusions are those shown on our website and order form when you order.
2. Your information and content
You are responsible for the information and materials you give us, including business details, services, prices, hours, photos, logos and text ("Your Content"). You confirm that:
- you own the business you are ordering for, or are authorized to order a website for it;
- Your Content is accurate, and you will tell us when it changes;
- you own Your Content or have permission to use it, and it does not infringe anyone's rights;
- your website and business comply with the laws and rules that apply to your industry, including licensing, advertising and pricing rules.
You give us permission to use, copy, edit and display Your Content as needed to build, host, update and support your website.
3. How we create your website, including AI tools
We use software tools, including artificial intelligence tools such as Anthropic's Claude, to help write and check website text based on the information you provide. Our process is designed to use only facts you give us and not to invent reviews, awards, credentials, prices or other claims.
No process is perfect. You are responsible for reviewing your website before approving it, and your approval confirms that its content is accurate and acceptable to you.
4. Ordering, previews, changes and approval
- After you order and pay the setup fee, we email you a preview of your website. Most previews arrive within 24 hours, but timing is not guaranteed.
- Your package includes two rounds of changes before launch, requested through the link in your preview email. Additional changes before launch may be quoted separately.
- When you approve your site, it goes live and your hosting plan begins. Approval means you accept the website as delivered.
- We may decline or cancel any order at our discretion, including orders that violate Section 13. If we cancel before delivering a preview, we will refund the setup fee in full.
5. Fees and payment
- Setup fee: paid in full when you order.
- Hosting and care: billed monthly in advance starting when you approve your site, through our payment processor, Stripe.
- Updates after launch: Starter updates are $25 each. Pro includes one small update per month; unused updates do not roll over. A "small update" means changes such as text, hours, prices, services or swapping photos that take about 30 minutes or less. New pages, redesigns and new features are quoted separately.
- Yearly hosting: if you choose to pay yearly, your plan renews each year on its anniversary. Unused months are not refunded if you cancel, except that if we end our services without cause, we will refund the unused months.
- Add-ons (such as Google Business Profile setup, extra rounds of changes or plan upgrades) are priced as shown on our website when ordered and are non-refundable once the work has been delivered. Google Business Profile changes may require you to complete Google's own verification steps.
- Prices are as shown at the time of your order. We may change prices for existing customers with at least 30 days' notice by email; you can cancel before the change takes effect.
- You are responsible for any taxes that apply to your purchase.
6. Refunds
- Before your first preview: if you cancel before we deliver your first preview, we will refund your setup fee in full.
- If you don't approve your site: if, after you have used both included rounds of changes, you decide not to approve your website, you may request a full refund of your setup fee by email within 14 days of receiving your last revised preview. When we issue the refund, we will take the preview down, and you will have no right to use the website's design or the text we wrote.
- After approval: once you approve your website, the setup fee is non-refundable, except where required by law.
- Refunds are not available for orders we cancel or remove under Section 13 (Acceptable use), and are limited to one refunded order per business.
- Monthly hosting fees are not refunded for partial months.
7. Hosting, availability and maintenance
We host websites using reputable third-party providers and monitor them for problems. We aim to keep your site online at all times, but we do not guarantee uninterrupted availability. Outages can be caused by our providers, internet problems, maintenance or events outside our control. We are not responsible for interruptions caused by third parties.
8. Failed payments and suspension
If a hosting payment fails and is not resolved within 14 days of our notice, we may suspend your website. If it remains unresolved 30 days after suspension, we may take the website down and delete its files.
9. Cancellation
Hosting is month to month. You may cancel at any time by emailing us. Your website stays online through the end of the period you have paid for, and is then taken offline. Before cancelling, you may request a copy of your website's files, which we will provide within a reasonable time if your account is paid in full.
We may end our services with 30 days' notice by email, and immediately if you materially breach these Terms.
10. Ownership
- You keep ownership of Your Content.
- Once your setup fee is paid in full, you own the final text written for your website.
- We keep ownership of our templates, designs, code, tools and systems. We grant you a non-exclusive, perpetual license to use the design and code of your delivered website for your own business, including on another hosting provider after you cancel.
11. Domain names
- If we register a domain for you, it is registered in your name or your business's name as the owner (registrant). We may manage it through our registrar account.
- The registrar will email the owner to verify the registration. You must complete this verification, usually within 15 days, or the domain may be suspended.
- Registration and renewal fees are billed to you at our cost unless your plan says otherwise. If renewal fees are not paid, the domain may expire.
- If you cancel, we will release your domain to you within 5 business days of your request, at no charge. This means we unlock it and give you the transfer code so you can move it to the registrar of your choice. Newly registered or recently transferred domains generally cannot be moved to another registrar for 60 days.
- If you use a domain you already own, you remain responsible for it, including renewals and settings.
12. Email forwarding
If we set up email forwarding for your domain, it is provided as a free convenience, with no guarantee that every message will be delivered. It is not an email mailbox or backup service.
13. Acceptable use
We do not build or host websites for businesses or content that is illegal, fraudulent or misleading; impersonates another person or business; involves adult or sexual content, gambling, or the sale of weapons or controlled substances; promotes hate, violence or harassment; or infringes others' rights. We may decline, suspend or remove any website that we reasonably believe violates this section.
14. Health care and regulated businesses
Our standard websites are informational and do not collect patient or client health information. If you operate in health care or another regulated field, you are responsible for making sure your website's claims comply with the rules that apply to you, and you agree not to ask us to add forms or features that collect protected health information.
15. Third-party services
Your website may link to or rely on services we do not control, such as online booking tools, maps, payment processors, hosting providers and domain registrars. Their terms apply to your use of them, and we are not responsible for their availability or actions.
16. Showcasing your website
We may display your website, business name and screenshots in our portfolio and marketing. You can opt out at any time by emailing us. If you received founding-client or promotional pricing in exchange for permission to showcase your site, opting out within 12 months of launch may end that pricing going forward.
17. No guarantee of results
We do not guarantee any particular results from your website, including search engine rankings, traffic, calls, bookings or sales.
18. Disclaimer
Except as expressly stated in these Terms, our services and websites are provided "as is" and "as available," without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose and non-infringement, to the fullest extent permitted by law.
19. Limitation of liability
To the fullest extent permitted by law: (a) we will not be liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue, sales, customers, data or goodwill, arising from or related to our services or these Terms; and (b) our total liability for all claims arising from or related to our services or these Terms will not exceed the amount you paid us in the 12 months before the event giving rise to the claim.
Some jurisdictions do not allow certain limitations, so some of these may not apply to you.
20. Indemnification
You agree to defend, indemnify and hold harmless Gravitt Digital LLC and its owners from any claims, losses and expenses (including reasonable attorneys' fees) arising from Your Content, your business, your website's claims, or your breach of these Terms.
21. Resolving disputes
If a dispute arises, please contact us first. We will try in good faith to resolve it informally within 30 days. If we cannot, the dispute will be governed by the laws of the State of Colorado, without regard to its conflict-of-law rules, and resolved in the state or federal courts located in El Paso County, Colorado, unless the law requires otherwise.
22. Changes to these Terms
We may update these Terms from time to time. We will post the updated Terms on this page with a new effective date and, for material changes, notify active customers by email at least 14 days before they take effect. Continuing to use our services after the effective date means you accept the updated Terms.
23. General
- These Terms, together with your order details, are the entire agreement between you and us about our services.
- If any part of these Terms is found unenforceable, the rest remains in effect.
- Our failure to enforce any part of these Terms is not a waiver.
- You may not transfer your rights under these Terms without our consent. We may transfer ours as part of a sale or reorganization of our business.
- Notices to you will be sent to the email address on your order. Notices to us should be sent to the address below.
